House Rental Agreement Guide for Maharashtra

Yogesh Nankar ·

Renting a house in Maharashtra — whether it is a flat in Pune, a bungalow in Nashik, or an apartment anywhere in the state — requires a properly drafted house rental agreement. This document, formally called a Leave and License Agreement, is your legal shield as a landlord or tenant. Without it, you have no enforceable rights.

This guide covers every aspect of house rental agreements specific to Maharashtra, from tenant rights to registration requirements.

What Is a House Rental Agreement?

A house rental agreement is a legal contract between a property owner (licensor) and a person who wants to live in that property (licensee). In Maharashtra, this agreement follows the Leave and License format under the Maharashtra Rent Control Act, 1999.

The agreement grants the tenant the right to occupy the residential property for a specified period in exchange for a monthly rent and security deposit. Unlike a lease deed (which creates stronger tenancy rights), a leave and license agreement keeps the ownership and control firmly with the landlord.

Tenant Rights Under Maharashtra Law

As a tenant with a registered house rental agreement in Maharashtra, you have the following rights:

Right to Peaceful Possession

The landlord cannot enter the property without reasonable notice (typically 24 hours) except in emergencies. The landlord cannot interfere with your day-to-day use of the property.

Right to Essential Services

The landlord cannot disconnect water, electricity, or other essential services to force a tenant to vacate. This is illegal under the Maharashtra Rent Control Act.

Right to Fair Rent

Once agreed upon, the rent cannot be increased during the agreement period unless an escalation clause is included. Even escalation must follow the agreed percentage.

Right to Security Deposit Refund

The security deposit must be refunded when you vacate the property, after deducting any legitimate dues or damages. The landlord cannot withhold the deposit without valid reasons.

Right to Receipt

You have the right to demand a receipt for every rent payment made.

Right Against Arbitrary Eviction

During the lock-in period and agreement term, the landlord cannot ask you to vacate without following the notice period and termination conditions specified in the agreement.

Landlord Duties

Landlords renting out residential property in Maharashtra have specific obligations:

Structural Maintenance

The landlord is responsible for major repairs — roof leaks, plumbing issues in main lines, structural damage, and electrical wiring problems in the main supply.

Property Tax

The landlord must continue paying property tax and ensure the property remains in habitable condition.

Disclosure

The landlord must disclose any known defects in the property before the agreement is signed.

Society Compliance

The landlord must ensure the tenancy is approved by the housing society (where applicable) and provide the tenant with a No Objection Certificate (NOC) from the society.

Registration

For agreements of 12 months or more, the landlord has a legal obligation to register the agreement. Both parties share this responsibility, but the landlord typically initiates the process.

Standard Terms in a House Rental Agreement

A standard house rental agreement in Maharashtra includes:

  • Duration: Typically 11 months, renewable by mutual consent
  • Monthly Rent: Fixed amount, payable by a specific date each month
  • Security Deposit: Usually 2-3 months’ rent for residential properties
  • Lock-in Period: Commonly 3-6 months
  • Notice Period: 1-2 months written notice for termination
  • Rent Escalation: 5-10% annual increase (if agreed)
  • Maintenance: Tenant pays minor repairs; landlord pays structural repairs
  • Permitted Use: Residential purposes only (unless otherwise specified)
  • Subletting: Prohibited without written landlord consent

For a detailed breakdown of all clauses, see our rental agreement form and template guide.

Furnished vs Unfurnished House Rental Agreement

The agreement requirements differ based on furnishing status:

Unfurnished Property

The agreement covers the bare property. The tenant brings all furniture and appliances. The agreement is simpler with fewer inventory-related clauses.

Semi-Furnished Property

Basic fixtures like fans, lights, kitchen cabinets, and wardrobes are provided. The agreement must include a list of items provided with their condition.

Fully Furnished Property

All furniture, appliances, and sometimes even utensils are provided. The agreement must include:

  • A detailed annexure listing every item
  • Condition of each item at the time of handover
  • Replacement responsibility (who pays if an appliance breaks due to normal wear and tear)
  • Depreciation terms for deductions from the security deposit

For furnished properties, the security deposit is typically higher (3-6 months’ rent) to cover potential damage to furnishings.

Registration of House Rental Agreements

When Is Registration Mandatory?

  2. Visit the Sub-Registrar’s office with both parties and two witnesses

Frequently Asked Questions

What documents are needed for a house rental agreement?

Both parties need Aadhaar card, PAN card, and passport-size photographs. The landlord also needs property ownership proof (index-II, property tax receipt, or sale deed). Check our complete documents required guide.

Can a landlord increase rent during the agreement period?

The landlord can only increase rent if a rent escalation clause is included in the agreement. Without such a clause, rent remains fixed for the entire duration. Most agreements include a 5-10% annual escalation.

What happens when the agreement expires?

When the agreement expires, the tenant must either vacate or sign a new agreement. Continuing to occupy the property without a new agreement can create legal complications for both parties.

Can the landlord deduct from the security deposit for normal wear and tear?

No. Normal wear and tear (faded paint, minor scuff marks) is expected and should not be deducted from the security deposit. Deductions are only valid for damage beyond normal use.

Is a house rental agreement different from a flat rental agreement?

No. In Maharashtra, the same Leave and License Agreement format is used for houses, flats, apartments, and villas. The clauses may vary slightly (for example, a house agreement might include garden maintenance), but the legal framework is identical.

Can I rent out a single room in my house?

Yes, you can rent out individual rooms. However, this requires a separate agreement specifically for the room being rented. See our room rental agreement guide for the specific requirements.
